Damac plans appeal to lawsuit in DIFC

An Irish couple that won a "default judgment" against Damac Properties for delays in handing over their unit will have one more fight on the horizon if the developer gets its way.
Noel and Lorna Gaffney won their case because Damac did not respond to their lawsuit. Now, Damac will have to prove to the court that it had a good reason for not responding or that it has a strong case to make before the DIFC Courts. Otherwise, Damac will have to pay them a Dh1.7 million (US$462,850) refund.
Here's the response that came after our story on April 21 from Damac's lawyer, Jonathon Davidson.

''This judgment has been entered on a default basis. Therefore the Court has not had the opportunity to consider any points in defense or hear Damac's substantive responses to the claims which have been made. Damac are appealing this judgment for the opportunity to state their case and to ensure that a fair and equitable result is ultimately achieved.''
