DUBAI // A woman who had not had sex with her husband for eight years then gave birth to a boy whom she registered under her other half’s name has been jailed for 18 months.
The husband, who works abroad, told prosecutors that he was surprised when his wife gave birth.
The Indian, 48, moved for work to Kuwait in 2006 and left his wife and only son in the UAE.
“She started making problems so I remained away, moving from one country to another but, in 2007, she filed a divorce case in India,” the husband told Dubai Criminal Court.
Last year friends in the UAE told him his wife had given birth.
“She gave birth on April 22, 2010, to a boy and registered him under my name – but we hadn’t had sex since 2006 so he couldn’t be my son,” the husband said.
He went to a police station and reported his wife, a 40-year-old nurse.
She was charged with having consensual sex with a man other than her husband and having a child with him. She was convicted and will serve a year in jail.
She was also convicted of obtaining a false birth certificate by registering the child in her husband’s name, and with using the false certificate to obtain a residency visa and Emirates ID for her son. For this she was jailed for an additional six months.
The father of the child, who is also from India, was charged with having consensual sex with the nurse. He was convicted and sentenced to six months in jail.
A laboratory report proved to the court that the accused were the child’s biological parents.
They both denied all charges last September.
Both will be deported after completing their jail terms.
