ABU DHABI // A man seeking to have his ex-wife’s custody of their two children revoked has had his request rejected by the Federal Supreme Court.
The ex-wife was granted custody of their 8-year-old daughter, A, and their 5-year-old son, Z, following their divorce.
The court had granted him a weekly meeting with his children every Saturday from 10am to 6pm, however she refused him the meetings.
The father filed a court order which compelled her to grant him the weekly visitation.
He then filed a lawsuit requesting her custody be stripped and passed over to him.
On November 11, 2014, the First Instance Court rejected the lawsuit, and the Appeals Court upheld the verdict, so he further appealed the ruling to the Supreme Court.
The court said that A and Z were still at an age where they should be under the custody of their mother, and the only reason to revoke her custody would be for the welfare of the children.
The court said it did not believe her refusal to grant visitation was reason enough to strip her of her custody.
